In this Privacy Policy we explain how we process the personal data of people who interact with Optiseeds through this website, and the rights you have under Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

2. What data we process

  • Identification and contact details: first name, surname, email, phone number, company and addresses.
  • Business details: tax ID (NIF/CIF) or VAT number, company name and, where applicable, website, to verify that you are a business or professional.
  • Order data: products ordered, invoicing, shipping and payments. We do not store card details: payment is made by bank transfer.
  • Communications: messages you send us via the contact form, email or WhatsApp.
  • Minimal technical data needed for the site to work and stay secure.

3. Purposes and legal basis

  • Managing your wholesale account application and verifying your professional status. Legal basis: taking pre-contractual steps.
  • Managing your account, orders, proformas, invoicing and shipping. Legal basis: performance of the contract and compliance with legal obligations (tax and accounting).
  • Responding to enquiries received via the form, email or WhatsApp. Legal basis: consent and, where applicable, pre-contractual steps.
  • Notifying you when a product is back in stock, if you request it. Legal basis: consent.
  • Ensuring the security of the website. Legal basis: legitimate interest.

We do not send marketing communications without your consent and we do not build profiles for advertising purposes.

4. Retention

  • Account applications not approved: up to 12 months, unless you ask us to delete them sooner.
  • Customers: for as long as the business relationship lasts and, afterwards, for the applicable legal periods.
  • Enquiries: for as long as needed to respond to them.
  • Back-in-stock notifications: until the notification is sent or you ask us to delete it.

5. Recipients and providers

We do not share your data with third parties unless required by law. To provide the service we use providers that act as data processors under contract:

  • Web hosting on servers located in the European Union.
  • Transactional email delivery (Amazon Web Services, EU region).
  • Invoicing and proforma software (Holded).
  • Carriers (UPS or others you choose) to deliver your orders.
  • WhatsApp (Meta), only if you choose to contact us through that channel.

6. International transfers

We process data within the European Economic Area. If any provider could access it from outside the EEA, the safeguards set out in the GDPR will apply, such as the European Commission's standard contractual clauses.

7. Your rights

You can exercise your rights of access, rectification, erasure, objection, restriction and portability, and withdraw your consent at any time, by writing to [email protected] or by post to the address above. You can also view and update your details from your account.

If you believe we have not handled your request properly, you can lodge a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es).
